The Prosecutor's Office has reportedly made a request on the rape case involving former Barcelona defender Dani Alves.

Dani Alves could remain behind bars for years following the latest reports in Spain.

This week, it was reported that the 40-year-old Brazilian footballer who has spent over 200 days locked up in Brians II prison could find himself incarcerated for even longer.

Alves has been in prison since January having been arrested for allegedly raping a 23-year-old lady at a popular nightclub in Barcelona.

The news comes following reports that Alves plans to sue his ex-wife Dinorah Santana over her ‘rapist claims’ made against the footballer, months after she publicly drummed her support for the former Brazil international.

Alves, who has seen several of his appeals thrown out the window, has been forced to alter his statements in a bid to secure his release on bail, at least.

Despite the allegations, the footballer has maintained that the sexual relations he had with the victim were consensual, something that the complainant has always denied.

The report from the aforementioned outlet reveals the prosecutor's request is not binding.

Once issued, it will be up to the presiding judge in the case to determine whether the request conforms to the facts prosecuted.

Alves was expected to stand trial before Christmas, however, reports indicate that the trial will finally take place in the first quarter of 2024.

However, Alves could reportedly reach an agreement with the Prosecutor's office - If this agreement were to be reached, with which all parties, including the Prosecutor's Office, would have to agree, Alves would avoid spending time behind bars.

The article of the Penal Code that includes the “crime of sexual assault with penetration” has a penalty that could range between four and 12 years in prison.
